Rules to remember when conducting or responding to an investigation:
- As a general rule, government employees must cooperate in criminal and non-criminal internal investigations.
- Government employees cannot be made to incriminate themselves.
- Managers (not just investigators) must issue warnings when conducting both criminal and non-criminal cases.
- Even if your superior orders you not to cooperate in an investigation, you can be held liable for obstruction of an investigation.
- Managers may not advise employees not to cooperate.
- You generally do not have the right to legal representation in an internal agency investigation.
