Description: In recent years, reports written by EEO investigators have come under heightened scrutiny by outside agencies, lawyers in discrimination cases, and the courts. EEO and human resources professionals who write reports as a result of EEO investigations have to make sure that those reports will withstand such scrutiny. Even if one conducts a thorough investigation, the report may still be subject to attack if it is not well written. Some key topics include: understanding the Faragher-Ellerth Affirmative Defense; crucial tips and template; addressing comparators and credibility; writing the report analysis; using EEOC guidelines; analyzing witness statements; ethical issues; attorney-client privilege; working effectively with counsel; analyzing evidence.
