OPM has done it again!!! Last it was fercca retirement violations that had to go to the high courts and millions of dollars in wrongful tax problems before they were ordered to correct retirement issues. I want what money I have out of that system. They have no leadership and anytime there is no leadership, there is no accountability and no accountability means nobody has to do anything but cover their own backs. It's a system of corruption where everyman's for themselves. They'll a bunch of renegades taking old folks pensions. No better than Maddoff and Enron. I believe they have stolen millions of dollars from former spouses over the years with their "court order acceptable for processing" and other unamended laws.
And sad part is we can't fault the sloppy work at OPM nor can we fault the 5 directors holding that position in less than 2years. It is Congresses responsibility to require IRS to uphold federal pension laws. Your Congressman needs to insist that heads roll whenever OPM workers fails in their fiduciary responsibility towards retiree's, beneficiaries and other alternate payees of pension funds. Heck, private industry has more protections against waste, fraud and abuse than pension holders at OPM. They think they can just deny these court orders and not give people the opportunity to correct eventhough pension laws states otherwise. And it is the IRS responsibility to enforce OPM pension laws. It's really sad to heard about all the former spouses who have gone bankrupt, lost their homes and health and maybe even lose their lives because of OPM court order benefits branch holding court orders for years and never responding. And then when they do respond they come up with any absurd excuse that is rubber stamped by MSPB.

Thanks to homelessformerspouse I got an opportunity to place my issues on a petition for Congressional Review. Turns out under Kennedy Versus Dupont, the Supreme Court has advised all of us to look to the document plan and stop crowding the courts with cases that could have been resolved through the legalities surrounding plan documents. That makes sense, only now OPM is refusing plan documents when the USCode clearly states these documents should be made available upon written request from beneficiaries.

Congress is currently being petitioned for fairer and legal treatments for the handling of divorce and legal separations. They have passed laws that OPM has refused to implement!!! You do have rights and together we can all lobby congress for enforcement. One such right is that you are suppose to be granted upon written request, a Summary Plan Description. This will clear up any guesswork on what you are or are not entitled to. Look it up in the USCode. Your entitlements are all there. Look it up in any plan document. There should also be a an 800# for former spouses to call with concerns or problems and your Congressman should know about all of this. I am going through a divorce and have been told by my lawyer that my husband is entitled to a portion of my retirement plus survivor benefits. The formula they are using is # of months married divided by the # of months employed divided by 2. I understand that part but I wonder if the reduction in the base retirement is reduced when a partial survivors benefit it elected. For instance, if I am only required to provide a reduced survivor benefit of $1600.00 monthly, how is the reduction to my retirement benefit computed?

Unfortunately, Christmas Tree, undeserving ex-spouses, both male and female, are being awarded a portion of our federal pensions every day. I think whether or not an ex-spouse receives part of one's retirement should be solely decided by the divorce judgement and not by the source of the pension, whether governmental or private.

My husband will be getting a portion of my CSRS when I retire according to the divorce decree, however, he wants it now and had petioned the court to get his share of what is now in the retirement fund, I am eligible to retire, I have 30 years in and am 62, but had not intended to at this time. Can he get a portion of it now, even though the decree says when I retire he will get a percentage every month? Thanks

My ex- has received a court-ordered portion of my CSRS retirement, when it occurs in the future. It is based on the number of years we were married. I want to be fair to her, but I'm concerned because she has been an employee of our county school system for the last 15 years and will also be receiving a pension from them. Will she literally receive "nothing" because of the GPO and other federal limits on CSRS pension income?

My dad was forced into early retirement because of health problems and that penalization in combination with what my mom got in their divorce settlement left him living on around $1200 a month with VA benefits for health coverage! If you don't diversify and plan ahead, your retirement planning can be shot to hell in a matter of a few months! I read some great information this week at http://www.expertretirementplanning.com/. Assuming everything will just be provided when you retire is a bad idea. Divorce happens, poor health happens. You have to get the information and plan accordingly.

Just to remind your readers that not only do the ex-spouses of Federal employees(not) get any "fringe" divorce benefits,if such benefits are silent,(they're not listed in the divorce decree) but if the Federal employee "Re-marries",then the ex-spouse gets no Social Security benefits etc;in the event of the death of said Federal employee.
Also,if you re-marry make sure you contact the OPM office,so they can mail you the proper form to assign your (current spouse) to receive the "Survivor Annuity",if not then your ex-spouse and not your new spouse gets the survivor annuity when you are deceased.

Wow, C.T., your outrage brought to mind the old saying "Me thinks thou doth protest too much." While I've been fortunate to have a tolerant spouse, my M-I-L was not so lucky. After 17 years of abuse, she was basically left destitute. My own mother didn't even fare as well.
While I do not relish my spouse's litigable ability to claim half of my hard earned federal pension, I realize there is a fairness aspect not wholly dependent on circumstance. While I often feel favoritism towards the female in our judicial system, I realize there are abuses and some folks just fall through the cracks.
Divorce is an acrimonious affair at best. At least with the laws being discussed in forums such as these, we may consider ourselves forewarned.

What a crock! Why should any able-bodied, intelligent woman get part of (usually)a man's federal pension? Time to change the view of men and women. A marriage doesn't work out, OK. The couple splits, maybe remarries, fine. Then, many years later, the ex-wife has a "legal" entitlement to part of her ex-husband's pension? Her contribution to their failed marriage was, to be fair, about 50%. What services has she provided to him subsequent. Tell Gloria Steinham and her FemaNazis that women can't have it all, to be equal, you have to work for it.

Great article, as usual, Tammy. I am not sure but are there not some special regulations relative to State Department employees? I do not believe the OPM regs even refer to the special circumstances presented by the State Department issues. Additionally many attorneys are not even aware of them as well.
