Washington DC hasn't a clue.
What is the difference in allowing one hour or one year to report, when there is overwhelming disincentive for covered entities nationwide to report breaches in the first place, even without federal fines and brand new untried breach laws?
It takes courage for a doctor with small practice to admit to patients that a computer was stolen in a burglary. When honesty bankrupts a practice built up over a career, what use are government threats?
Think about how many computers have been stolen from doctors' offices across the nation in the last year. Now, how many patients have been told of those breaches?
Really, what difference does that hour make?
