I have two questions regarding military deposits. I have followed this issue in your columns and have received a computed military deposit amount that now appears in my LES. I am retired from active duty and now must try to determine whether to have my active duty service count toward my retirement as a civil servant under FERS. I was active duty (USN) from June 1976 to July 1996. I entered the federal workforce in June 2001.
I have two questions. 1. My understanding is that making the military deposit does not in any way affect my current military retired pay. It is only once I waive it that it is stopped. I also understand that once I waive it, presumably just before I retire under FERS, it will stop and that I will have no penalty or repayment requirement for all the years I collected military retired pay. Is this correct? 2. My former spouse receives 25 percent of my current retired military pay. How is her entitlement affected/calculated if I make the military deposit and waive retired pay from the military just before retirement under FERS?
