Dear Un-Civil Servant,
I've been there and am no longer with the agency I blew the whistle on. I think your approach of keeping your mouth shut is probably the approach most now take who have tasted the Whistleblower Protection Act -- to the sad loss of ferreting out waste, fraud, and abuse. But when messengers are killed and the criminals rewarded, who can blame anyone for keeping quiet and keeping one's job. What a sad commentary that federal employees are now too afraid to speak out. They should change the name Whistleblower Act to CPA-- Criminal Protection Act.

I don't need protection!!!! I've decided to keep my mouth shut and allow them to violate the laws and regulations. It wasn't worth it the first time I used the Whistleblower Act and things seem to only get worse. They don't really want to know the truth anyway. As far as punishing the supervisor for retaliation forget about it. He got rewarded because everyone (three levels up) was involved!!! So please be real, unless you've been there don't speak.

Same old story, some conscientious person notifies his supervisor/managers of a problem and instead of investigating and correcting the problem, they retaliate against the complainer. No amount of legislation will fix this problem until they prosecute to the fullest extent of the law those managers/supervisors who threaten and retaliate against the whistleblowers. Providing more so-called protection isn't enough. They have to investigate and when they find that an agency or firm has retaliated unlawfully, then they have to prosecute the individuals in those agencies and/or companies for their crimes.

I've personally seen the harassment and I've been a whistleblower who has felt the harassment.
It is such an easy problem to fix. In a Whistleblower Protection Act case investigated by OSC and litigated before MSPB -- if a manager is found to have engaged in whistleblower retaliation, that manager is terminated. First offense no Douglas Factor review -- automatic termination. Let's see how much retaliation occurs from the SES on down once the first three managers are fired, with all the publicity attached. I suspect managers will become whistleblowers as they turn on their more senior managers to protect their jobs.
The real problem in this area is defining who a whistleblower actually is -- the legal test is insane and doesn't protect anybody. Anyone who speaks up against waste, fraud, and abuse by any channels should be protected under the Whistleblower Protection Act regardless of whether speaking up is part of one's job or not!
