It seems that this legislation is very specific, not affecting the 2001 No FEAR Act or the 1989 Whistleblower protections; but targeted specifically at government environmental specialists and professionals seeking to pursue indiscretions and improper conduct with regard to the Clean Water Act among other fundamental pieces of environmental legislation. Given the Bush Administration's consistent efforts to weaken or tamper with effective health-insuring environmental requirements and/or legislation (to the point of completely eviscerating any sort of significant protections), this is not surprising: The New Source Review, Clear Skies Act (Mercury emissions reporting), brownfields, "voluntary" rather than mandatory compliance measures, etc. Disappointing to say the least.

Don't see how Powers vs Tennessee has any bearing on this issue since the Powers case was protected by State immunity.

What is going here is not that hard to figure out. The government wants to withold the truth on a variety of issues, from the public. If the government decides to lie, cheat or mislead the public they want the law to be there for them to hide behind. Can you imagine how many lies they could tell if they get the ruling in this case. They will not stop at these levels, they will continue until they mute every government employee from telling the truth. Another case on its way to the supreme court is Edmonds v DOJ. This is the one where the analyst found the government was not telling the truth about terrorists or at least looking the other way when the information came forward.
