This "cascading" appears to violate the intent of the Competition in Contracts Act in that proposals are solicited but some are rejected without being looked at or evaluated. Full and open competition is not being afforded all offerors in this type of competition. The FAR allows for set-asides and other methods to meet statutory requirements in a competitive environment. This appears to be limiting full and open competition in violation of FAR part 6. Calling this method full and open competition is more than a stretch of creative contracting.
