EEOC is such a joke that any "repositioning" won't hurt anything. Anyone who's had to work with these people knows exactly what I'm talking about. I was involved in class action age discrimination suit against the Army. We had three filing cabinets full of proof and a videotape of an Army rep saying we were "too old and untrainable" to do the update of the Army logistics program (LMP). But EEOC declared that the class was invalid (after 3 years) and then told us we couldn't file individually because it was too late and that we should have filed individually (after they told us we couldn't file individually during the class action).
So don't look for this to hurt anything, maybe it'll actually help someone get their case worked in their favor.
