In my opinion, OPM, like the rest of the civilian side of the federal government, is hurting for resources. Let's be fair and patient. The very same group that drafted the OPM NO FEAR regulation is the group working to change the entire HR program at DHS by regulation and is tracking all the changes going on at DoD.
I'm sure the No FEAR regs will be updated once they see all the comments. Timeliness requires resources.

The No FEAR Act provision that agencies will have to repay the judgment fund will have little impact on discrimination case reduction. The judgment fund only pays for those cases in which the agencies lose in federal court. Few complaints make it to federal court, due to time constraints and expense. Agencies are already paying for those cases not making it to federal court, and have been since 1991 when compensatory damages became available.
The one thing that would have a major impact on preventing discrimination is a requirement that managers found responsible for discrimination, either by the EEOC or in federal court, be disciplined with a minimum of a 10-day suspension for the first offense and removal for the second offense. After all, these are federal employees and they are violating Title VII of the Civil Rights Act. Until managers are held accountable, discrimination will continue to exist in the federal government, regardless of who pays the settlements.
